Sale Information Down Payments and Minimum Deposits: Buyer must provide a 20% non-refundable deposit of sale price to secure purchase of horse. The deposit will be applied toward the full purchase price and will be returned in full only if the general health of the horse is determined to be deficient by a licensed veterinarian. Should the sale proceed as agreed, the remaining balance will be due seven (7) days before pickup and must be paid in full before the horse leaves the custody of Mary Mack Farms. If the horse is to be left with Mary Mack Farms for more than fourteen (14) days, Buyer must pay for boarding at the rate of $150 per month. Boarding fees are in addition to any deposits or the full purchase price. Transfer of Ownership: Mary Mack Farms will deliver a signed bill of sale upon payment of the full purchase price, boarding fees and any other costs agreed to by Buyer and Mary Mack Farms. Mary Mack Farms will transfer title with the Tennessee Walking Horse Breeders and Exhibitors Association (TWHBEA) and will ensure that papers are forwarded to Buyer by the Association. Costs of transfer must be paid by Buyer and included with payment of the full purchase price. Pre-Purchase Exam: Buyer is encouraged to obtain a pre-purchase examination by a veterinarian of Buyer's choice. Cost of exam is the responsibility of the Buyer. If Buyer waives the pre-purchase examination, Buyer is agreeing to take the horse AS IS without any representations by Mary Mark Farms regarding the horse's physical condition, conformation or fitness for any specific purpose, and if Buyer does not proceed with the sale, all deposits will be forfeited in full. Mary Mack Farms is providing contact information for veterinary clinics in the general vicinity of the farm, but will not recommend any specific clinic. Logan County Animal Clinic, LLC
O'Brien Veterinarian Hospital Insurance: Risk of loss, including all vet bills and other costs associated with the horse, will pass to Buyer upon receipt of the minimum deposit. Although Mary Mack Farms will exercise the same care with the subject horse as it provides to its own horses, it will not guarantee the horse's continuing health or that it will not experience an accident while remaining on the premises. Therefore, if the horse is to be left on the premises for more than fourteen (14) days following receipt of the deposit, Buyer must purchase equine insurance for fatality, major medical and loss of use sufficient to cover the purchase price plus any other costs Buyer may wish to insure. Insurance must name Mary Mack Farms as "loss payee"; provided, however, Mary Mack Farms will be entitled only to as much of the proceeds as is required to cover the purchase price and its expenses, with the balance payable to Buyer. Certificates; Tests; Shipping: Mary Mack Farms will provide a current Coggins test from a veterinarian of the farm's choice. All other tests and examinations are the responsibility of Buyer. Mary Mack Farms inoculates its horses against diseases common to its area, but Buyer should determine if the horse will require protection against diseases that are specific to Buyer's area of the country. Buyer must make arrangements with a shipper of its choice and provide Mary Mack Farms with notice of the expected pick-up date at least five (5) days in advance. All costs of shipping are the responsibility of Buyer. Buyer should also confirm if there are shipping requirements specific to the destination to which the horse is being taken or to any states through which the horse must travel.
